Resignation letter – what you need to know
Resigning in writing gives you and your employer a clear record of when notice was given and when your employment ends. Keep a copy and ask for confirmation that the letter was received – an email reply is enough.
How much notice do I need to give?
- Your contract comes first. Most employment contracts set a notice period – often one month, and longer for senior roles. Check your contract or staff handbook.
- The legal minimum for an employee who has worked for at least one month is one week’s notice (Employment Rights Act 1996), unless the contract says more.
- Counting the notice: notice normally starts the day after your employer receives the letter. If you want to leave earlier, ask – your employer can agree to release you early.
Holiday, pay and documents
You are paid as normal during your notice period. Holiday you have built up but not taken must be paid in your final pay, unless your employer asks you to take it during the notice period. After you leave you should receive your P45 – you will need it for your next employer or for HMRC.
Garden leave and references
Your employer may put you on garden leave – you stay employed and paid but do not come to work. Employers do not have to give a reference, but if they do, it must be fair and accurate.
Frequently asked questions
Can I resign by email?
Usually yes, unless your contract requires notice in a particular form. A signed letter (or a PDF attached to an email) is the safest record.
Do I have to give a reason for resigning?
No. You can simply give notice. Keeping the letter short and professional is usually best.
Can I take back my resignation?
Only if your employer agrees. Once clear notice has been given, the employer can accept it and hold you to the leaving date.
What happens if I leave without working my notice?
You may be in breach of contract and your employer could, in theory, claim losses. In practice it is better to agree an earlier leaving date.
